1. Acceptance of Terms
By accessing the Site or engaging Pro Air for services, you confirm that you are at least 18 years old and able to enter into a binding agreement. These Terms apply to all visitors, users, and customers.
2. Our Services
Pro Air provides residential and commercial air duct cleaning, dryer vent cleaning, air duct deodorizing and sanitizing, UV-C light installation, HVAC (AC and furnace) cleaning and tune-up services, and related services. The specific scope of any job will be confirmed with you before work begins. We reserve the right to refuse or discontinue service in our reasonable discretion.
3. Quotes & Estimates
Quotes and estimates we provide are based on the information available to us at the time and are not a final, binding price unless confirmed in writing. The final price may change if on-site conditions differ from what was described (for example, additional vents, system size, accessibility, or the actual condition of the system). We will communicate any change before performing additional work.
4. Scheduling, Access & Cancellations
You agree to provide safe and reasonable access to the areas and equipment to be serviced at the scheduled time. If our team cannot access the property or the system at the scheduled appointment, or if no one is available to provide access, we may need to reschedule.
If you need to cancel or reschedule, we ask that you notify us in advance. We reserve the right to charge a reasonable fee for missed appointments or late cancellations where applicable, which will be communicated to you.
5. Payment Terms
Payment is due upon completion of the service unless we agree otherwise in writing. We accept the payment methods communicated at the time of service. For commercial or multi-unit work, payment terms may be set out in a separate written agreement or invoice. Late or unpaid balances may be subject to reasonable late fees and collection costs as permitted by law. Financing, where offered, is provided subject to separate terms and approval.
6. Communications & SMS Consent
By providing your phone number, you agree that Pro Air may contact you by phone call and text message (SMS) regarding your inquiry, quote, appointment, and service. Where you opt in, we may also send promotional messages. Message frequency varies, and message and data rates may apply. You can opt out of texts at any time by replying STOP, or reply HELP for help. Consent to receive marketing messages is not a condition of purchasing any service. Please see our Privacy Policy for more detail.
7. Customer Responsibilities
You agree to: provide accurate and complete information about your property and system; disclose any known hazards, defects, or pre-existing damage; secure pets and fragile or valuable items prior to the appointment; and obtain any necessary permission to authorize work (for example, if you are not the property owner). You represent that you are authorized to request service for the property in question.
8. Warranties & Disclaimers
We take pride in our work and perform our services in a professional, workmanlike manner. Any specific service guarantee we offer will be stated by us in writing.
Our services are not a substitute for professional medical, safety, or engineering advice, and we do not guarantee the elimination of all allergens, mold, odors, or fire risk.
9. Limitation of Liability
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.
10. Indemnification
You agree to indemnify and hold harmless Pro Air and its owners, employees, and contractors from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms, your misuse of the Site, or your violation of any law or the rights of a third party.
11. Intellectual Property
All content on the Site β including text, graphics, logos, the Pro Air name and logo, images, and design β is owned by or licensed to Pro Air and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without our prior written permission.
12. Third-Party Links
The Site may contain links to third-party websites or services that we do not control or endorse. We are not responsible for the content, policies, or practices of those third parties.
13. Privacy
Your use of the Site and our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
14. Governing Law & Venue
These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-laws rules. Subject to the arbitration provision below, you agree that any dispute not subject to arbitration will be brought exclusively in the state or federal courts located in or serving Elkhart County, Indiana, and you consent to the jurisdiction of those courts.
15. Dispute Resolution & Arbitration
We hope to resolve any concern informally first, so please contact us before pursuing a formal dispute. If we cannot resolve it, you and Pro Air agree that any dispute arising out of or relating to these Terms or our services will be resolved by binding arbitration on an individual basis, rather than in court, except that either party may bring a qualifying claim in small claims court.
This section does not prevent either party from seeking injunctive or equitable relief to protect intellectual property or confidential information.
16. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last Updated” date above and post the updated Terms on this page. Your continued use of the Site or our services after changes take effect means you accept the updated Terms.
17. Severability & Entire Agreement
If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full force. These Terms, together with our Privacy Policy and any written agreement or invoice for a specific job, make up the entire agreement between you and Pro Air regarding the Site and our services, and supersede any prior understandings. Our failure to enforce any provision is not a waiver of it.
